Two Year Limited Warranty for SmartDispenser™
Fishman Corporation (Fishman) warrants its SmartDispenser™ Linear Drive Dispensing System (SmartDispenser™) to be free from defects in materials and workmanship for a period of two years from the date of purchase.
Fishman further warrants its related software and firmware designed by Fishman for use with the SmartDispenser™ will execute its programming instructions when properly installed on that system. Fishman does not warrant that the operation of the system software or firmware will be uninterrupted or error-free. The foregoing warranty shall not apply to defects resulting from improper or inadequate maintenance by the Buyer, Buyer-supplied software or interface, unauthorized modifications or misuse, operation outside the environmental specifications for the SmartDispenser™ or improper site preparation or maintenance.
Fishman obligation under this warranty is limited to repairing or replacing, at its own option, any such defective SmartDispenser™. To obtain service under warranty, you must obtain a Return Material Authorization (RMA) number from Fishman. Products must be returned to Fishman with transportation charges prepaid and must be accompanied by a brief description of the problem and proof of date of purchase. Fishman reserves the right to refuse to give an RMA number, unless a valid warranty registration card or electronic registration has been filed with Fishman within 15 days of purchase. This warranty does not apply to equipment that has been modified or altered in any way.
Except as provided herein, Fishman makes no warranties, expressed or implied, including warranties of merchantability and fitness for a particular purpose.
Except as provided above, in no event will Fishman be liable for direct, indirect, special, incidental or consequential damage arising out of the use of this product, even if advised of the possibility of such damage. Specifically, Fishman is not liable for any costs, such as lost profits or revenues, loss of equipment, loss of use of equipment, costs of substitutes, claims by third parties, or otherwise.
